May I take the K-12 Education Expense Credit on my IL-1040 if I was a nonresident of Illinois?

No.  This credit is only allowed if the following apply:

  • You are the parent or guardian of a full-time student who was under the age of 21, and
  • Your student is a resident of Illinois, and
  • Your student attended kindergarten through twelfth grade at an elementary or secondary school in Illinois during the tax year.

See the Schedule ED Form and InstructionsPublication 112, Education Expense Credit;  Publication 119, Education Expense Credit General Rules and Requirements for Home Schools; or Publication 132, Education Expense Credit General Rules and Requirements for Parents and Guardians, for more information.
